Terms of Use for FreeChat

Agreement to Our Legal Terms

We are SmartWay (“Company”, “we”, “us”, or “our”). We operate the mobile application FreeChat (the “App”), as well as any related products and services that refer to these Legal Terms (collectively, the “Services”).

FreeChat is a location-based communication app that lets registered users discover people nearby on a map, chat with friends and groups, and, where available, make voice and video calls.

These Legal Terms are a legally binding agreement between you and SmartWay about your access to and use of the Services. If you do not agree with these Legal Terms, you must stop using the Services immediately.

1. Our Services

FreeChat lets users create accounts, find and connect with nearby users, exchange messages and media, join group conversations, and take part in calls over the internet. The App is free to use.

2. Eligibility and Accounts

• You must be at least 13 years old to use the Services. If you are under the age of legal majority where you live, you may use the App only with the permission of a parent or guardian.
• You must provide accurate registration information and keep it up to date.
• You are responsible for keeping your login credentials safe and for all activity on your account.

3. Intellectual Property Rights

We own or license all intellectual property rights in the Services, including software, design, logos, graphics, and media. You may not copy, distribute, or exploit any part of the Services without our written permission.

4. User Content

You keep ownership of the messages, photos, and other content you share (“User Content”). You grant us a limited license to store, transmit, and display it only as needed to operate the Services. You are solely responsible for your User Content and confirm that you have the right to share it.

5. Prohibited Conduct

We have zero tolerance for objectionable content and abusive users. You may not use the Services to:

• Share, request, or promote any content that sexually exploits or endangers children. This is strictly forbidden and will be reported to the authorities (see our Child Safety Policy).
• Harass, bully, threaten, stalk, or intimidate anyone, including by misusing another user’s location
• Post sexually explicit, violent, hateful, or discriminatory content
• Impersonate another person, create fake accounts, or commit fraud or scams
• Send spam, advertising, or malicious links or software
• Promote illegal activities, drugs, weapons, or self-harm
• Infringe other people’s privacy or intellectual property rights
• Interfere with, hack, or reverse engineer the App

6. Messaging and Call Rules

Messaging and call features must be used respectfully and lawfully. Do not record or share other users’ conversations, images, or calls without their consent. Harassment, grooming, threats, or inappropriate behavior in chats or calls may result in suspension or permanent account termination.

7. Reporting, Blocking and Moderation

• You can report any user, message, or call directly in the App, and you can block users you do not want to hear from.
• We review reports manually and act on objectionable content within 24 hours by removing the content and, where appropriate, ejecting the user who posted it.
• We may remove any content or suspend or ban any account that violates these Terms, with or without notice.

8. Location Features

Nearby discovery uses your device location, only with your permission. Be careful about meeting people you have met online: meet in public places and tell someone you trust. SmartWay is not responsible for users’ conduct offline.

9. Privacy

Our Privacy Policy explains how we collect and use your data. It is part of these Terms.

10. Disclaimers and Limitation of Liability

The Services are provided “as is” and “as available”, without warranties of any kind. We do not guarantee that the Services will be uninterrupted or error-free, and we are not responsible for content posted by users. To the maximum extent permitted by law, SmartWay is not liable for any indirect, incidental, or consequential damages arising from your use of the Services.

11. Modifications and Termination

We may modify, suspend, or discontinue the Services at any time. We may update these Terms, and continued use after an update means you accept the revised Terms. You may stop using the App and request deletion of your account at any time, as described in our Privacy Policy.

12. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the country in which SmartWay is established, without regard to its conflict-of-law rules, and without prejudice to any mandatory consumer protection rights you have where you live.
