Agreement to Our Legal Terms

We are SmartWay (“Company”, “we”, “us”, or “our”). We operate the mobile application Forex AI Advisor (the “App”) and any related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

These Legal Terms are a legally binding agreement between you (“you”) and SmartWay concerning your access to and use of the Services. 1. Our Services

Forex AI Advisor lets you select forex, gold, and crypto symbols and receive AI-generated technical and fundamental analysis (including BUY/SELL signals, entry zones, and key price levels) based on real-time and historical market data from third-party providers and Claude AI (Anthropic). The Services are provided for educational and informational purposes only.

Forex AI Advisor is not a broker, does not hold your funds, and does not execute trades on your behalf.

2. Eligibility and Accounts

You must be at least 18 years old (or the age of legal majority in your country, if higher) to use the Services. By using the Services, you confirm that you meet this requirement. If you create an account, you agree that the information you provide is true and accurate, that you will keep it up to date, and that you are responsible for keeping your login details secure and for all activity under your account.

3. Intellectual Property Rights

We own or license all intellectual property rights in the Services, including code, design, logos, and media. These are protected by copyright and trademark laws. You may not copy, modify, or distribute any part of the Services without our prior written permission.

4. Acceptable Use

You agree not to:

• Use the Services for any unlawful, fraudulent, or abusive purpose.
• Resell, republish, or redistribute the analysis or market data provided by the App, or present it as licensed investment advice.
• Scrape, reverse engineer, or overload the Services or their underlying APIs.
• Attempt to gain unauthorized access to our systems or other users’ accounts.
• Use the Services in violation of any applicable financial regulation or law.

5. AI-Generated Content and Market Data

Analysis in the App is generated automatically by artificial intelligence. AI output can be incomplete, outdated, or wrong. Market data from third-party providers may be delayed or contain errors. We do not guarantee the accuracy, completeness, or timeliness of any analysis, signal, price, or level shown in the App, and you should verify any information before relying on it.

6. Financial Disclaimer

The content provided by Forex AI Advisor is for informational and educational purposes only and does not constitute financial advice, investment recommendations, or a solicitation to buy or sell any currency, commodity, cryptocurrency, or financial instrument. Trading forex, gold, crypto, and other leveraged instruments involves substantial risk of loss and may not be suitable for all investors. Past performance is not indicative of future results.

SmartWay is not a licensed financial advisor, broker, or investment firm. Always consult a qualified financial advisor before making any trading or investment decision. You alone are responsible for your trading decisions and their results.

7. Limitation of Liability

The Services are provided “as is” and “as available”, without warranties of any kind. To the fullest extent permitted by law, SmartWay is not liable for any trading losses, lost profits, or direct, indirect, incidental, or consequential damages arising from your use of, or reliance on, the Services.

8. Third-Party Services

The Services rely on third-party providers, including Anthropic, market data providers, and Google (Firebase and, where ads are shown, AdMob). We are not responsible for the availability or content of third-party services. See our Privacy Policy for how data is handled.

9. Modifications and Termination

We may modify, suspend, or discontinue the Services at any time. We may suspend or terminate your access if you violate these Legal Terms. If we update these terms, we will revise the “Last updated” date, and continued use of the Services means you accept the new terms. You may stop using the Services and request account deletion at any time.

10. Governing Law

These Legal Terms are governed by and interpreted in accordance with the laws of Morocco, without regard to its conflict of law principles.
