Terms of Use for MyCredit

Agreement to Our Legal Terms

We are SmartWay (“Company”, “we”, “us”, or “our”). We operate the mobile application MyCredit (the “App”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

MyCredit is a personal finance app that helps users track their income and expenses and manage informal credits, debts, and IOUs with friends, family, or business contacts.

These Legal Terms are a legally binding agreement between you, whether personally or on behalf of an entity (“you”), and SmartWay, about your access to and use of the Services. If you do not agree with all of these Legal Terms, you must stop using the Services immediately.

1. Our Services

MyCredit lets users record money flows, track informal credit (debts and IOUs) between people, and set due dates and reminders. MyCredit is a record-keeping tool only: it does not lend money, process payments, or connect to bank accounts. You must be at least 13 years old to use our Services.

2. Intellectual Property Rights

We are the owner or the licensee of all intellectual property rights in our Services, including code, design, logos, and documents. These are protected by copyright and trademark laws. You may not copy, use, or redistribute any part of the Services without our permission.

3. User Representations

By using the Services, you confirm that the registration information you submit is true and accurate, that you will keep it accurate, and that you are at least 13 years old.

4. User Responsibilities

You are responsible for how you use the App and for any content you enter (for example, credit entries, names, or notes). You may enter information about other people only for your own record keeping. You agree not to use the App for any illegal, abusive, or fraudulent purpose, and not to impersonate others or misuse the Services in any way.

5. No Financial Advice

Balances and summaries in MyCredit are calculated from the data you enter and are provided for information only. They are not financial, legal, or tax advice, and MyCredit records are not legal proof of a debt.

6. Privacy

Our Privacy Policy explains how we collect and use your data. It is part of these Terms.

7. Disclaimers and Limitation of Liability

The Services are provided “as is” and “as available”, without warranties of any kind. We do not guarantee that the Services will be uninterrupted or error-free. To the maximum extent permitted by law, SmartWay is not liable for any indirect, incidental, or consequential damages, including financial losses, arising from your use of the Services.

8. Modifications and Termination

We may modify or discontinue any part of the Services at any time. If these Terms are updated, continued use of the App after notice means you accept the updated Terms. You may stop using the App and request deletion of your account at any time, as described in our Privacy Policy.

9. Governing Law

These Terms are governed by and interpreted according to the laws of Morocco, without regard to conflict-of-law rules, and without prejudice to any mandatory consumer protection rights you have where you live.
