AGREEMENT TO OUR LEGAL TERMS

We are SmartWay (“Company”, “we”, “us”, or “our”). We operate the mobile application CHEQUES (the “App”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

CHEQUES is a cheque-tracking app that helps users manage post-dated cheques they have issued or received, keeping track of amounts, payees, dates, and statuses.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and SmartWay, concerning your access to and use of the Services. If you do not agree with all of these Legal Terms, then you are expressly prohibited from using the Services and must discontinue use immediately.

1. OUR SERVICES

CHEQUES allows users to track and manage cheques (issued or received), including amounts, payees or issuers, cheque dates, and statuses. The App is designed for adult users to document cheque transactions and assign due dates. You must be at least 13 years old to use our Services. The App is not intended for children under 13.

2. INTELLECTUAL PROPERTY RIGHTS

We are the owner or the licensee of all intellectual property rights in our Services. This includes content such as code, design, logos, and documents. These are protected by copyright and trademark laws. You may not copy, use, or redistribute any part of the Services without our permission.

3. USER REPRESENTATIONS

By using the Services, you represent that all registration information you submit is true and accurate and that you will maintain its accuracy. You agree to comply with these Legal Terms and confirm you are not under 13 years old.

4. USER RESPONSIBILITIES

You are responsible for how you use the App and for any content (e.g., cheque entries, names, or notes) you input. You agree not to use the App for any illegal, abusive, or fraudulent purposes. You agree not to impersonate others or misuse the service in any way.

5. MODIFICATIONS AND TERMINATION

We reserve the right to modify or discontinue any part of the Services at any time. If these terms are updated, continued use of the App after notice means you accept the updated terms.

6. GOVERNING LAW

These Terms are governed by and interpreted according to the laws of Morocco, without regard to conflict of law rules.
